01About these terms
These terms apply to teskesoftware.com (the “website”) and to software products offered by Teske Software, an independent software business in the Netherlands run by Damian Teske (“Teske Software”, “we”, “us”). By using the website or one of our products, you agree to these terms.
They have three layers: general website terms, product terms (including StockByLocation), and a note on client projects, which are always covered by a separate agreement.
02Using the website
The website gives information about Teske Software, our services and our products. You're welcome to read, link to and share it. Please don't:
- try to gain unauthorised access to the website or the server it runs on;
- interfere with its availability, for example through excessive automated requests;
- present our content or branding as your own.
We try to keep the information accurate and current, but it is provided for general information. Descriptions of features, availability and prices may change; the information in the product itself, or on Shopify's plan page, is what counts at the moment you subscribe.
The website links to other sites, such as product websites and Shopify. We aren't responsible for the content or practices of sites we don't operate.
03Our products
Products are labelled on the website with their current status, for example “in development”. Products in development may change significantly, may not yet be publicly available, and are not offered for sale until stated otherwise.
Where a product is distributed through a platform such as the Shopify App Store, the platform's own terms also apply to how you install, pay for and uninstall it.
04StockByLocation
The service
StockByLocation is a Shopify app that displays inventory availability for selected store locations on product pages. It reads products, inventory and locations from your Shopify store and doesn't modify them. You're responsible for the accuracy of the inventory in your Shopify store and for the texts you configure in the app; the app displays what Shopify reports at the time of the request.
Plans, trial and billing
- The Starter plan costs US$3.99 per month and includes a 14-day free trial.
- You choose and approve the plan on Shopify's plan-selection page. Charges are billed by Shopify through your Shopify account, under Shopify's terms of service, together with any applicable taxes.
- The plan and price shown on Shopify's plan page at the time you approve it apply to your subscription. If we change pricing for existing subscribers, we'll tell you in advance, as Shopify's billing system requires.
- Without an active plan, the app's admin asks you to choose a plan and the storefront block does not show availability.
Cancelling
You can stop using StockByLocation at any time by uninstalling it from your Shopify admin. Uninstalling ends the app's access to your store and its subscription in Shopify's billing system. Questions about specific charges can be sent to support@teskesoftware.com; how charges, credits and refunds are processed is governed by Shopify's billing system and terms.
Fair use
Please don't use the app to break the law, to overload its infrastructure, or to try to access other merchants' data. We may suspend access in case of abuse or a security risk, and will tell you why where we reasonably can.
Availability and support
We work to keep StockByLocation reliable, but we can't guarantee it will always be available or error-free; it also depends on Shopify's platform. Support is provided by email at support@teskesoftware.com on a reasonable-effort basis, without guaranteed response times.
Changes and discontinuation
We may improve or change features. If we ever decide to discontinue StockByLocation, we'll give installed stores reasonable notice in advance.
05Client projects
Custom development, consulting and hosting work is always agreed in writing per project, including scope, price, timing, ownership of the results, warranties and liability. Nothing on this website is a binding offer for such work, and these terms don't replace a project agreement.
06Intellectual property
The website's content, design, the Teske Software name and logo, and our products' software are owned by Teske Software unless stated otherwise. A subscription gives you the right to use a product for its intended purpose; it doesn't transfer ownership of the software. Third-party names, such as Shopify, are trademarks of their respective owners. Fonts used on the website are licensed under the SIL Open Font License.
07Liability
The website and our products are provided “as is” and “as available”. To the extent permitted by law:
- we are not liable for indirect or consequential damage, such as lost profit, lost sales or lost data;
- for StockByLocation, our total liability is limited to the amount you paid for the app in the twelve months before the event that caused the damage.
These limits don't apply where the law doesn't allow them to (for example, in the case of intent or deliberate recklessness), and they don't affect any mandatory rights you have as a consumer.
08Privacy
How we handle personal data is described in our privacy policy and, for the app, in the StockByLocation privacy policy.
09Governing law
These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law gives you the right to go to another court. We'd always prefer to talk first. Most things can be solved with an email.
10Changes to these terms
We may update these terms. The date at the top shows the latest version. For significant changes that affect paying StockByLocation users, we'll give notice before they take effect.
